Legal Notice and Terms of Use

In compliance with Spanish Law 34/2002 on Information Society Services (LSSI-CE), the operator of datoki.tech is:

Datoki is an on-demand GPU compute platform that allows registered users to launch Jupyter environments with GPU access through fixed-price sessions using prepaid balance available in their account.

Accessing and using Datoki implies acceptance of these terms. Users agree to:

• Use the service for lawful purposes only and in compliance with applicable regulations.
• Not use GPU environments for cryptocurrency mining, cyberattacks, illegal content distribution, or any activity that infringes third-party rights.
• Not attempt to access systems or data belonging to other users.
• Keep access credentials confidential.

Breach of these terms may result in immediate suspension of access without entitlement to a refund of any remaining balance.

• Available balance is topped up via one-time payment through Stripe. Balance has no expiry date while the account remains active.
• Session cost is deducted from the balance based on the environment type and the published commercial duration for each plan.
• Prices are shown excluding tax. Applicable VAT is calculated automatically based on the billing country of the user.
• Datoki issues a receipt for each top-up. Fiscal invoices are issued upon explicit user request via the form available on the receipt page.

Datoki applies a simple refund policy focused on the operational reliability of the beta.

• If a machine is reserved but the Jupyter environment never becomes available to the user, the amount charged for that session is refunded automatically to the balance.
• No support ticket or manual refund request is needed for that operational refund.
• Balance corresponding to sessions that started correctly and were accessible to the user is non-refundable, even if the session later expires or is ended early.
• Any issue outside that scenario may be reviewed case by case via info@datoki.tech, without creating a general right to a refund of unused balance.

Datoki is currently in public beta. The service is provided on a best-effort basis. No continuous availability or minimum uptime is guaranteed. In the event of a prolonged outage not attributable to the user, proportional balance compensation will be considered.

La Navaja Suiza shall not be liable for damages or losses arising from use of the service, including data loss, environment interruptions, or the results of computations run in GPU environments. Users are responsible for saving copies of their work before ending a session.

All elements of the Datoki platform (design, code, brand, logos) are the property of La Navaja Suiza or its licensors. Reproduction in whole or in part without express authorisation is prohibited.

Content created by the user in GPU environments (notebooks, data, models) is the exclusive property of the user. Datoki does not access or retain that content after the session ends.

These terms are governed by Spanish law. Any dispute arising from use of the service shall be submitted to the courts of the place of residence of the user , or those otherwise competent under applicable law.
